These Referral Terms & Conditions (“Terms”) govern participation in the Point Blank referral program (“Program”). By participating in the Program (including by using any items arising in connection with the Program), you agree to be bound by these Terms.
1. Eligibility
1.1 The Program is open only to persons located in Australia and who ordinarily reside in Australia. No purchase of any goods or services offered in connection with Point Blank is necessary to participate in the Program.
2. Earning offerings
2.1 Referrals must be valid and confirmed by Point Blank to be eligible for offerings under the Program. Referrals that are determined in Point Blank’s sole discretion to be fraudulent, including the use of fake or duplicate emails, will be disqualified.
3. Program integrity
3.1 Point Blank reserves the right to cancel, suspend, or modify the Program at any time if, in its sole discretion, the Program is compromised or cannot be conducted as intended.
3.2 Any attempt by any person to deliberately damage or tamper with the referral system, or undermine the legitimate operation of the Program, may be in violation of criminal and civil laws. If such an attempt is made, Point Blank reserves the right to seek remedies and damages from any such person, including criminal prosecution.
4. Representations and warranties
4.1 By participating in the Program, you represent and warrant that:
(a) you have not been induced in any way to participate in the Program, and
(b) you have not induced any other person (whether by offering a benefit or otherwise) to sign up to Point Blank.
5. Release and liability
5.1 To the fullest extent permitted by law, you release and hold harmless Point Blank and its officers, directors, employees, agents, affiliates, co-branded partners, subsidiaries, retailers and agencies from any claim, injury, damage, liability or loss that may occur, directly or indirectly, in whole or in part, from your participation in the Program or the use or redemption of any reward.
5.2 Point Blank makes no representations, warranties or guarantees of any kind concerning any reward and disclaims all implied warranties to the extent permitted by law.
5.3 Point Blank is not in any way responsible or liable for any damage, loss or injury resulting from the acceptance, possession or use of any reward.
5.4 You agree to indemnify, defend and hold harmless Point Blank and its affiliates, officers, directors, employees and agents from and against any and all claims, losses, liabilities, damages, costs and expenses (including reasonable legal fees) arising in connection with your participation in the Program, including any breach, or purported breach, of these Terms by you.
6. Redemption period
6.1 Referral offerings must be redeemed by you within 30 days of being issued. Codes or links that expire beyond this window will no longer be valid.
7. Errors and omissions
7.1 Point Blank is not responsible for any typographical or other errors in connection with the administration of the Program, including errors in printing, offering, or announcing any reward.
8. Entire agreement
8.1 These Terms constitute the entire agreement between you and Point Blank in relation to the Program, and supersede any prior understandings or agreements.
9. Governing Law
9.1 These Terms are governed by the laws of Western Australia. You irrevocably submit to the non-exclusive jurisdiction of the courts of Western Australia in relation to any dispute or matter arising in connection with the Program.
9.2 If any provision(s) of these Terms are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect.
10. Variation and waiver
10.1 These Terms may only be waived or varied by Point Blank in its sole discretion. Point Blank may update these Terms without notice to you.
